Members-Only Scavenger Hunt Term and Conditions for Participation- Liability Waiver:
(This is meant to be a family fun game, with lots of giving, so please don’t make it complicated!) 

XTREME Scavenger Hunts, LLC: Terms of Participation

 

By subscribing, you agree to the following terms:

 

1. Indemnification: You agree to indemnify, defend, and hold harmless XTREME Scavenger Hunts, LLC, its members, employees, and affiliates from any claims, damages, or expenses (including attorney fees) arising from your participation, misuse of services, or violation of any applicable laws or rules.

 

2. Game of Skill: This is a skill-based activity that requires problem-solving, critical thinking, and physical activity. It is not a game of chance or gambling. Prizes are awarded based on performance. 

 

3. Participation at Your Own Risk: Participation is voluntary and at your own risk. You assume full responsibility for your physical and legal ability to engage in all activities. XTREME Scavenger Hunts, LLC is not liable for any injuries or damages incurred during participation.

 

4. No Refunds/No Guarantees: Subscriptions are non-refundable but can be canceled at any time, effective with the next billing cycle. Cancellations must be requested via email at xtremescavengerhunts@gmail.com.  Participation does not guarantee you will win. 

 

5. Disqualification: Any rule violations, including but not limited to cheating, harassment, or sharing clues, will result in immediate disqualification without refund. Please review our full rules and regulations on our website.

 

6. Property Damage: You are responsible for any property damage caused during your participation. You agree to reimburse XTREME Scavenger Hunts, LLC for any damage you cause to property during the activity.

 

7. Limitations of Liability: XTREME Scavenger Hunts, LLC will not be liable for indirect, incidental, or consequential damages arising from your participation. Our total liability is limited to the amount you paid for the subscription within the six months preceding any claim.

 

8. No Warranty: The service is provided "as is," without any warranties or guarantees regarding accuracy, reliability, or suitability for any particular purpose.

 

9. Third-Party Claims: You agree to indemnify XTREME Scavenger Hunts, LLC against any claims from third parties arising out of your actions during the scavenger hunt, including any legal fees incurred by XTREME Scavenger Hunts, LLC in defending such claims.

 

10. Waiver of Litigation: You waive any right to initiate or participate in litigation against XTREME Scavenger Hunts, LLC, its affiliates, or employees related to your participation in any activities, except where prohibited by law.

 

11. Cancellation Policy: To cancel your subscription, email xtremescavengerhunts@gmail.com. Cancellations will be effective after confirmation and will take effect with your next billing cycle (monthly or yearly). No refunds will be issued.

 

By subscribing, you acknowledge that you have read, understand, and agree to these terms. You assume all risks associated with your participation in this game of skill and agree to comply with all rules outlined on our website.
